Abstract

Australian copyright law is currently undergoing a number of significant changes. Three influences for change can be identified. First, there is the periodic modification of copyright law in response to technological change. Secondly, the domestic Australian law is required to be brought into line with changes in the international copyright regime. Thirdly, Australian copyright law, based as it is upon principles derived from the English legal tradition, has, since its inception, been under a constant pressure to effect a rapprochement with copyright principles derived from the Continental European copyright tradition. This paper examines some of these developments together with some of the principal recent cases which emphasize these developments. Subjects touched on include moral rights protection and performers' rights.
