Abstract

This article in French is a study written by a retired French Judge of Appeals who acts as a neutral in non-judicial dispute resolution. The article was previously published on paper in the "Gazette du Palais" issued in Paris. In it the author analyses what is mediation and what is not, especially by comparison with arbitration, and how the profile of mediator differs from that of arbitrator. He explains why, from his point of view, mediation seems superior to arbitration. The article also contains reference to a website providing other French language material concerning dispute resolution as well as a comprehensive multilingual bibliography.
