State Government Mining Royalties: Requited Taxes or Duties of Excise?

Abstract

The author argues that the definition of federal duties of excise can be expanded to include certain mining royalties levied by Australian State Governments. He proceeds to examine the ways in which legislation and regulations can be amended to ensure that royalties cannot be constitutionally challenged.
