The Uniform Domain Name Dispute Resolution Policy as an Alternative to Litigation
Abstract
The author surveys the objectives of the Uniform Domain Name Dispute Resolution Policy (UDRP) approved by the Internet body ICANN, its application and results to date. Several criticisms of the policy including forum shopping and complainant bias are examined and possible reforms are described. Both procedural and substantive shortcomings of the policy are discussed. The author concludes by comparing the benefits of UDRP and litigation for current disputes in Australia.
