Australian Anti-Discrimination Law and Sexual Orientation: Some Observations on Terminology and Scope
Abstract
This article highlights the deficiencies in existing Australian legislative schemes that proscribe sexual orientation discrimination. Issues of terminology and scope are addressed in this article, indicating a fundamental mismatch between the content of the law in this area, and the needs of the people whom the grounds purport to protect. Existing legislation requires amendment, and legislation should be introduced in the two Australian jurisdictions which currently do not have statutes rendering discrimination on the grounds of sexual orientation unlawful.
