Legal Recognition of Same-Sex Relationships: Where to from Here?
Abstract
Clayton believes that regulations, policies and practices which give preference to couples are the most far reaching area of discrimination against gay men and lesbians. This is because they almost invariably only recognise heterosexual marriage-like relationships and because they impact things which impact on almost every area of life and death. This article examines these areas of discrimination affecting gay men and lesbians. They include the areas of the legal status of homosexual relationships; adoption, guardianship and conception of children; immigration and taxation concerns.
After considering the areas of discrimination, Clayton looks at the options for future action and identifies difficulties within both heterosexual and homosexual stances, and within the legislation.
