The European Union's Conflict of Law Rules - A Re-Evaluation
Abstract
This article examines the effectiveness of the 1980 Rome Convention in determining the applicable law in contractual matters. The author concludes that any European lawyer is now able to find the relevant law in a relatively short and succinct piece of legislation rather than having to embark on a tortuous investigation into the often ambiguous, often conflicting case law. However, the author also suggests that the Rome Convention still leaves much to be desired, especially in relation to the effectiveness and clarity of certain provisions.
