The Potential of the Law of Torts to Assist in the Protection of Children
Abstract
This paper explores possible avenues in the law of torts to assist in the protection of children. The author examines social and political constructions of the family in England and Australia. The English case of Khorasandjian is looked at as providing a means of protection through the law of nuisance. The paper also looks at some further legal dimensions in the protection of children in Australia and England.
