Constructing a Liability: Bryan v Maloney
Abstract
The author, a final year law student and an architecture graduate looks at the possible consequences for builders of the implications of the High Court of Australia decision in Bryan v Maloney. He discusses various aspects of the law of torts dealt with by this decision including the possible extended meaning of proximity and the implication that builders may be liable not just to their client but to subsequent property owners for loss sustained.
