Abstract

This paper analyzes the failure of the United States Roe v. Wade case to resolve the abortion controversy. The author argues the choice of viability as the point where protection of fetal life becomes a compelling state interest is inherently flawed and has proved unworkable in the twenty-four years since Roe was decided. Instead the author proposes the stage of development marked by the emergence of human hands.
