Compensation for Native Title: The Theory and the Reality
Abstract
Chris Humphry, of Hunt and Humphry Solicitors looks at the issue of compensation under the Native Title Act and contrasts the how it should work in theory verses how the process works in practice. The author examines the effect of statutes such as the Compulsory Acquisition Act and of issues such as multiple claimants over the same area of land. The article also takes into consideration claims and future acts, the right to negotiate procedure and exploration activities and projects.
