Abstract

The article discusses the significance of the Mabo (1) and Mabo (2) decisions on native title rights in Australia. The procedure for validating titles under the Native Title Act 1993 (Cth), and for granting new titles under this Act is addressed. Hunt explores the significance of the Wik decision as it relates to the mining industry. The article progresses to a discussion of the Ok Tedi decision and the impact of resource development on environmental degradation. Hunt discusses the effect of international conventions and particularly the role of the United Nations in the protection of indigenous rights.
