Abstract

The writer considers the legal aspects of refusal of consent to medical treatment on medical grounds, particularly focussing on refusal of blood transfusions by Jehovah's Witnesses. The situations in which courts may (and have) overridden patients' wishes are identified. The paper concludes with an examination of the ethics of overriding patients' informed decisions based on religious objections.
