Cybersquatting and Trademark Infringement
Abstract
This article examines the legal minefield surrounding trademark infringement on the internet by so called "cybersquatters". It examines the US Anti Cybersquatting Infringement Act of 1999 which was the first Act of its kind to be introduced. The author examines the effects of the new Act upon Domain Name Infringement; Trademark URL name disputes and the Act's implications on Free Speech and illustrates these points with US case law. The article provides a brief examination of the Act itself and offers some insight into the problems of using a traditional law system on something as widespread, dynamic and global as the internet.
