Sub-Bailment On Terms and the Australian Consumer
Abstract
The author examines the implications for consumers of the Privy Council decision in "Pioneer Container" in relation to the law of bailment. In particular it examines whether the safeguards in the doctrine, as incorporated by the Privy Council, compares with protection afforded to a consumer in contract. It is important to ensure that the doctrine of sub-bailment on terms does not work an injustice amongst those whom, in every other respect, the law is at pains to protect.
