Internet Service Provider Liability for Copyright Infringements of Subscribers: American and Australian Developments

Abstract

The expansion of the Internet has brought about a great change in modern society. We can now exchange knowledge, information and ideas on a universal scale quickly and easily. With the growth of the Internet, however, intellectual property abuses have drastically increased. As the actual infringer is often times hard to find or not able to satisfy a judgment, Internet Service Providers, while being vital to promoting and expanding the Internet, often found themselves at the receiving end of many lawsuits for the infringement. Many nations, including Australia and the United States, have recently enacted legislation to combat the uncertainty. This article compares the history and evaluates the legislative effort of both nations.
