Promise or Pretence - Compliance with the Intergovernmental Agreement on the Environment: The National Environment Protection Council (Western Australia) Act 1996
Abstract
An analysis of the extent to which the National Environment Protection Council (Western Australia) Act 1996 complies with the Intergovernmental Agreement on the Environment. Based on a consultancy report undertaken by the Murdoch University Environmental Policy and Law Centre prepared for the Legislative Assembley of Western Australia Standing Committee on Uniform Legislation and Intergovernmental Agreements, this paper argues that the WA Act does not facilitate meaningful participation in the National Environmental Protection Council. The article suggests a number of amendments which would ensure that WA complies with the Intergovernmental Agreement on the Environment. The recommendations provide a method of incorporating National Environmental Protection Measures into State law while Still preserving the legislative Supremacy of the Western Australia Parliament.
