Protection of Celebrities Names and Trade Marks under the ICANN Uniform Domain Name Dispute Resolution Policy
Abstract
The article examines how internet domain name disputes are handled under ICANN's Uniform Domain Name Dispute Resolution Policy (UDRP), particularly in regard to celebrity names and trademarks. The author outlines the scope of the UDRP and then discusses relevant court decisions, concluding that the UDRP does not protect celebrity names without proof of a trademark right, that 'cybersquatting' has been outlawed by the policy, and also that the country of residence of the disputants can be a determinative factor.
