HIV/AIDS and Its 'Willing Executioners': The Impact of Discrimination
Abstract
The author contends that discrimination against lesbians and gay men and people suffering from HIV/AIDS remains systemic. This is further problematised by a legal system which does not address the underlying problems that can be seen to cause HIV/AIDS. The author contends that the law can do much to rectify the situation. In order to do so, however, the legal system must adopt a more human rights based approach aimed at addressing the many societal and legal forces that enhance a person's vulnerability to the virus. The author concludes that law reform is needed and can be used to create the type of supportive environment conducive to positive behavioural changes amongst those groups most at risk of HIV/AIDS.
