For Love or Money? The Legal Regulation of Surrogate Motherhood
Abstract
This article discusses the current legislative distinction which exists in Australian jurisdictions between commercial and altruistic surrogate motherhood. It questions why this categorisation of surrogacy exists and examines some ramifications it holds for reproduction and family. In conclusion the article suggests a number of reasons as to why legislative reform is necessary to remove this existing categorisation of surrogacy arrangements.
