Abstract

This article deals with the functions of Native Title Representative Bodies under the new amendments to the Australian Native Title Act 1993 (Cth). It provides an outline of the Native Title Amendment Act 1998 (Cth), including an examination of the "fairness", "representativeness" and "accountability" provisions, as well as a consideration of the Minister’s powers and responsibilities. The author proceeds to critique the probable social and political consequences of these provisions against their intended objectives, as well as considering the difficulties faced by these bodies in pursuing their functions under the new regime.
