Sexual Orientation and the Law: 10 Years of the South Australian Equal Opportunity Act 1984
Abstract
This article reviews the success of the South Australian Equal Opportunity Act 1984 in relation to sexual orientation. The author analyses the complaints of discrimination lodged under the sexuality provisions since 1984, and includes three case studies. The first two case studies involve complaints from people who are transexual, and the third involves the landmark case of David Paul Jobling, who is homosexual. The article concludes with some general comments on the success of the Act as a remedy for those whose rights are violated, and in fostering unprejudiced attitudes in the community.
