Abstract

Native title has been acknowledged as part of the common law of Australia since 1992, and has been regulated by statute since 1994. It has been the subject of numerous judicial and administrative decisions, most of which seem to have added to the general confusion and uncertainty pervading this rapidly developing area of the law. This paper cuts through much of the detail and complexity in an attempt to explain the key issues and their relevance to resources project development and investment in Australia.
