The Seriousness of the Offence: Proportionality in Sentencing Sexual Offenders in Western Australia
Abstract
This article discusses approaches to the sentencing of those convicted of sexual offences. It considers the principle of proportionality as it relates to various factors including the harm inflicted, culpability of the offender and seriousness of offence. The author argues that application of this standard of proportionality requires a realistic understanding of the nature of the crime for which an offender is sentenced, and where that crime fits in the continuum of gravity of the offence.
