Abstract

The author reviews Japanese Small Claims Procedure which was introduced in January 1998 and outlines the key processes and procedures involved in Small Claims Procedure in Japan, exploring its successes and limitations. The author observes the purpose of the procedure to be increased accessed to justice through a 'people's court' which allows dispute resolution without the need for legal representation. Advantages of the system include simplicity, efficiency and cost-effectiveness.
