Lawyers and Dispute Resolution: What Do They Think And Know (And Think They Know)? - Finding Out Through Survey Research
Abstract
This article traces the design of empirical survey research aimed at discovering the knowledge of and attitudes towards non-judicial dispute resolution processes held by lawyers. It touches on the concepts and issues which are of significant interest today to those who are interested in the lawyer's role in dispute resolution and how a questionnaire may be constructed to explore them. The article presents some of the principles of empirical research of this nature, gives some guidance on how it may be conducted successfully and refers to the author's survey of lawyers in Western Australia and the preliminary results gained from it.
