"The lack of uniformity in defamation law between the States and Territories has been the subject of much criticism for over twenty five years. In a recent short paper, Outline of possible national defamation law, the Commonwealth Attorney-General has put forward a broad blueprint for a nationally consistent law. Unless the States and Territories agree to bring their defamation laws into line with the paper, the Commonwealth has said it will develop legislation to override existing State and Territories' law. This Research Note briefly reviews the major proposals contained in the Commonwealth paper."

From the introduction "Just two decades ago in most Australian states and territories, men were able to rape their wives with immunity. Rape in marriage was quite simply not a crime. While state legislatures have enacted laws that now address men's licence to rape1 women with whom they share marital or established relationships, our understanding of whether this resulted in effectively changing the social, cultural and legal responses to sexual violence by male intimate partners is surprisingly limited."

The UNHCR definition of people of concern' includes asylum-seekers, refugees returning home, and people uprooted within their own countries so-called internally displaced persons (IDPs). During 2003, 3.5 million people were repatriated from refugee camps, 26 000 were resettled in industrialised countries and 807 000 claims for asylum were lodged in industrialised countries."

From the introduction "Family violence and sexual assault are reported to be at crisis levels in many Indigenous communities. In response to calls from Indigenous people for change, a number of state and territory governments have established Task Forces, drafted policy documents, and held inquiries into the nature and extent of the violence. This Briefing Paper provides an overview of the key issues and findings from recent reports and research into family violence and sexual assault in Indigenous communities. Four sexual assault workers across the country also spoke to ACSSA about what is happening in their service areas to address sexual assault in Indigenous communities. An overview of the state and federal governments' policies and reports into family violence are provided in an annotated bibliography."

The Commonwealth plan for reforming defamation law in Australia [pdf]
A Research Note by the Law and Bills Digest Section of the Australian Parliamentary Library dated 21 July 2004. "The lack of uniformity in defamation law between the States and Territories has been the subject of much criticism for over twenty five years. In a recent short paper, Outline of possible national defamation law, the Commonwealth Attorney-General has put forward a broad blueprint for a nationally consistent law. Unless the States and Territories agree to bring their defamation laws into line with the paper, the Commonwealth has said it will develop legislation to override existing State and Territories' law. This Research Note briefly reviews the major proposals contained in the Commonwealth paper."
